INTERNATIONAL CAMPAIGN FOR FREEDOM OF (AS) Mapuche political prisoners, FAIR TRIAL, NO LAW AND TERRORISM IN CAÑETE mistrial

Los (as) undersigned, want to accompany the letter of the families of Mapuche political prisoners convicted in the trial of the City Cañete, we adhere to and solidarity with the legitimate request for cancellation and the implementation of a new and fair trial with an independent tribunal, competent and impartial and without the application of Law 18,314 or Terrorism Act.
Mr. Milton Juica
President of the Supreme Court of Chile
Present

Relatives of Mapuche political prisoners prosecuted recently in the city of Cañete, Bío Bío region, want to convey to you our deep concern about the situation of violations incurred during the development of the judicial process and ended finally with a conviction, why our families maintain a liquid hunger strike from 15th March.

As you know they were part of the Mapuche group of 34 were more 80 days on hunger strike to demand, among other things, that they are not anti-terrorist law applied (18,314), ie have the possibility of a fair trial. However, despite the agreement with the government, between November and February, developed a trial against 17 Mapuche, who have applied this standard by the prosecutors and private plaintiffs: forestry companies and government representatives, the latter through its commitment to all the evidence presented by the prosecution, including witnesses secret antiterrorism law authorizes.

In the famous sentence on 22 March, members of the Oral Criminal Court, Mr. Carlos Muñoz and Jorge Diaz, expressed his conviction have formed the alleged involvement in the events investigated and prosecuted primarily through the testimony of secret witness (called "witness No. 26). However, in Case rejected the classification of terrorist events, which is an obvious contradiction.

An alarming situation is that Mr. Judges considered in its ruling on "hearsay" of a Police Department who allegedly heard the statement "voluntary" one of our family (also charged and convicted), who allegedly would have charged and indicted auto other Mapuche. In this regard, we stress that this incident was reported to the justice and public opinion, because the statement was obtained under torture consisting with the medical certification of the injuries. However, in an unprecedented move, the Procuracy of Temuco decided not to endure the lawsuit, filing the case, and not investigating serious acts of torture reported by the Mapuche.

Moreover, the largest legal aberration was the fact of double jeopardy to which they were subjected our family, who for the same offense were prosecuted by the civilian and military justice at the same time. Although the Military Court of Valdivia, December 16 2010, our family decided to acquit credited for not finding the facts investigated. Currently the case is filed in the Court of Appeals of Concepción, without being aware of what their next processing. We are dismayed by the situation occurs that if the acquittal was not ratified and had a setback, ie re-processing to each of our relatives would be generated in this way, again, a double jeopardy, and that this fact was seen , tried and acquitted by the Military Courts, and now tried and convicted in the Court of Cañete.

you will be aware that the Chilean State has received a report by the Human Rights Commission in November 2010, which established the violation of human rights leaders and members of the Mapuche people have been prosecuted and convicted under Law 18,314, particularly through the use of witnesses "faceless" (IACHR Report 176/10). Today the state risked international condemnation by an international tribunal such as the Inter-American Court of Human Rights, which can only be of concern to this Honorable Court.

Our family, all of our people social activists, Pilquiman Llanquileo Ramón, José Huenuche Reiman, Jonathan Mendez Huillical were sentenced to 20 years in prison and Hector Llaitul Carrillanca to 25 years. We are convinced that were violated rights guaranteed by the constitution, these are: due process and fair trial.

Therefore, we demand a mistrial and conduct a new trial by an independent, competent and impartial and without the application of Law 18,314, or Law Terrorism. Furthermore, we demand the immediate ratification of the acquittal that issued the Military Court of Valdivia.

We also present you some of the people and organizations who have joined us in this call for justice and solidarity with our just demand.

Sincerely,
Relatives of the Mapuche Political Prisoners sentenced in Cañete.

Continued implementation of the Terrorism Act Mapuche political prisoners on trial in Cañete, Chile, January 2011

PUBLIC STATEMENT

Barcelona, January 2001

Civil Platform for Free Mapuche Political Prisoners-Barcelona, the international community expressed concern about the situation Mapuche political prisoners, currently being tried in the Tribunal Oral de Cañete, south of Chile.

Despite the parliamentary discussions generated from the hunger strike that made 34 Mapuche Political Prisoners in 2010, which lasted more 80 days in protest of the use of anti-terrorist law against Mapuche social activists and double jeopardy to which they are being subjected to civil and military justice, we find that not being in compliance with fair trial guarantees ;
in the process now being developed into 17 of these Mapuche brothers, 5 of which are affected by double jeopardy.

The Mapuche prisoners are being tried under this law, inherited from the era of the dictatorship, as criticized by United Nations agencies such as the Human Rights Council, Chile is part of that. This Council has repeatedly demanded the non-use of this law and its amendment under the international human rights standards.

international observers have attended this trial have indicated that the implementation of the Terrorism Act in this case has involved the following facts:

 • · Secret was applied Research for much of the process, which has limited the right to defense.
 • · The preventive detention has been applied to the 17 prisoners was between 1 year and eight months.
 • · legal aberration is noted that maintains a 5 Mapuche double judicial process, civil and military courts.
 • · continues to be seen that the use of faceless witnesses, the prosecution has presented to date 36 people who either are identified and whose testimony can not be verified by the defense.
 • · is stated the requirement of a disproportionate sentence by the prosecution, seeking between 103 and 52 years in prison.

These facts are evidence of continued discriminatory treatment of the Mapuche in Chile. Constant persecution and criminalization of the Mapuche social protest, initiated by the governments of the Concertación government of Ricardo Lagos and Michelle Bachelet has not finished with the current government.

express our firm opposition to such judicial practices that do not correspond to a country that aspires to democracy and overcoming discrimination and social exclusion.

denounce the international community this fact reflecting the shortcomings in our country's human rights, justice and democracy.

reiterate our commitment to the demands of justice for the Mapuche prisoners, as well as the international community denounced this situation.

We call upon the fulfillment of international human rights standards in all trials of Mapuche political prisoners.

appreciate your dissemination
