Barcelona, January 2001
Civil Platform for Free Mapuche Political Prisoners-Barcelona, the international community expressed concern about the situation Mapuche political prisoners, currently being tried in the Tribunal Oral de Cañete, south of Chile.
Despite the parliamentary discussions generated from the hunger strike that made 34 Mapuche Political Prisoners in 2010, which lasted more 80 days in protest of the use of anti-terrorist law against Mapuche social activists and double jeopardy to which they are being subjected to civil and military justice, we find that not being in compliance with fair trial guarantees ;
in the process now being developed into 17 of these Mapuche brothers, 5 of which are affected by double jeopardy.
The Mapuche prisoners are being tried under this law, inherited from the era of the dictatorship, as criticized by United Nations agencies such as the Human Rights Council, Chile is part of that. This Council has repeatedly demanded the non-use of this law and its amendment under the international human rights standards.
international observers have attended this trial have indicated that the implementation of the Terrorism Act in this case has involved the following facts:
- · Secret was applied Research for much of the process, which has limited the right to defense.
- · The preventive detention has been applied to the 17 prisoners was between 1 year and eight months.
- · legal aberration is noted that maintains a 5 Mapuche double judicial process, civil and military courts.
- · continues to be seen that the use of faceless witnesses, the prosecution has presented to date 36 people who either are identified and whose testimony can not be verified by the defense.
- · is stated the requirement of a disproportionate sentence by the prosecution, seeking between 103 and 52 years in prison.
These facts are evidence of continued discriminatory treatment of the Mapuche in Chile. Constant persecution and criminalization of the Mapuche social protest, initiated by the governments of the Concertación government of Ricardo Lagos and Michelle Bachelet has not finished with the current government.
express our firm opposition to such judicial practices that do not correspond to a country that aspires to democracy and overcoming discrimination and social exclusion.
denounce the international community this fact reflecting the shortcomings in our country's human rights, justice and democracy.
reiterate our commitment to the demands of justice for the Mapuche prisoners, as well as the international community denounced this situation.
We call upon the fulfillment of international human rights standards in all trials of Mapuche political prisoners.
appreciate your dissemination
