Relatives of Mapuche political prisoners prosecuted recently in the city of Cañete, Bío Bío region, want to convey to you our deep concern about the situation of violations incurred during the development of the judicial process and ended finally with a conviction, why our families maintain a liquid hunger strike from 15th March.

Moreover, the largest legal aberration was the fact of double jeopardy to which they were subjected our family, who for the same offense were prosecuted by the civilian and military justice at the same time. Although the Military Court of Valdivia, December 16 2010, our family decided to acquit credited for not finding the facts investigated. Currently the case is filed in the Court of Appeals of Concepción, without being aware of what their next processing. We are dismayed by the situation occurs that if the acquittal was not ratified and had a setback, ie re-processing to each of our relatives would be generated in this way, again, a double jeopardy, and that this fact was seen , tried and acquitted by the Military Courts, and now tried and convicted in the Court of Cañete.
you will be aware that the Chilean State has received a report by the Human Rights Commission in November 2010, which established the violation of human rights leaders and members of the Mapuche people have been prosecuted and convicted under Law 18,314, particularly through the use of witnesses "faceless" (IACHR Report 176/10). Today the state risked international condemnation by an international tribunal such as the Inter-American Court of Human Rights, which can only be of concern to this Honorable Court.
Our family, all of our people social activists, Pilquiman Llanquileo Ramón, José Huenuche Reiman, Jonathan Mendez Huillical were sentenced to 20 years in prison and Hector Llaitul Carrillanca to 25 years. We are convinced that were violated rights guaranteed by the constitution, these are: due process and fair trial.
Therefore, we demand a mistrial and conduct a new trial by an independent, competent and impartial and without the application of Law 18,314, or Law Terrorism. Furthermore, we demand the immediate ratification of the acquittal that issued the Military Court of Valdivia.
